Legal Question in Wills and Trusts in Massachusetts

Dad passed in 2004, all papers signed off at lawyers, sister ex-trix. Less than 2 years ago went to sell piece of property left to me by my father. According to the state none of the properties belong to me or my sister. The state of MA. siezed or took over all of Dad's "estate" because acording to them he died with out a will. The attorney NEVER PROBATED his will. It took about a year to free up my house and we are still trying to get back the other 2 properties. Many hours in Cambridge for our lawyer, many!We paid all the taxes over the years to Maynard. We carried on not knowing any of this happen until I went to sell. Would the town have been notified back in 2005 from the state that they took over? We were caught in the perfect storm. Do we have any recourse? What liability does the original law firm have to us? They clearly didn't do thier job. This has been so stressfull for us. Any advice would be appreciated. Thank you

You are really going to need to bring your paperwork to an attorney and review it in person. There may be a perfectly good explanation for what happened, and there may not be. As executrix, your sister may or may not share in some of the liability for what occurred, unless she was lied to or misled by her attorney. If you don't have an attorney helping you now, I would invite you to contact our office so we can explore your options.
