Business Law

My husband was in a Motor Vehicle crash in Michigan a few yrs ago. He recives workmans comp and PIP Injury benefits from auto insurance. I am 1/3 owner of the home care company that takes car of him, and I provide care for him also. If his case goes to litigation, would I have to testify on behalf of the comapny against him?

Re: Business Law

Why would you think your testimony would be against him, if you are providing home care assistance to him, or are a part owner in a company that is providing services to him? Your testimony would likely just be to prove that he does require the help that is being provided, and should receive compensation accordingly.

Furthermore, Michigan has the "spousal privilege" wherein certain communications (most) between spouses are privileged.

You should consult with your own lawyer if your testimony is required, as more information is needed to give you thorough legal advice.
