Legal Question in Credit and Debt Law in Michigan

Who is responsible for medical billing?

I was told that in Michigan, anyone who signs a consent for surgery for a minor child becomes responsible for all billing for that surgery. Can anyone confirm this? My ex-husband was responsible for my son's surgery and the day of surgery supposedly signed all paperwork for billing responsibility, yet the surgeon says it is my signature on the ''consent for surgery'' form dated the date of surgery and thus, I am responsible for the bills. If this were stated to me, I would NOT have signed the consent form as I knew I was not responsible for the bills, my ex-husband was. Any assistance in this matter would be greatly appreciated.

Re: Who is responsible for medical billing?

Are you seriously saying that you would not have agreed to the surgery that your child needed if you had to pay for it? I would suggest to you that if your Ex is legally bound to pay for it, then he will be required to re-imburse you.

Get down to the court ASAP and file a motion for him to pay the expenses according to the judgment of divorce provisions for medical care. First, though send him a letter certified asking him to take responsibility for whatever the judgment requires him to do.

You don't want to present the argument to the court that you would have refused your child necessary medical care.
