Legal Question in DUI Law in Michigan

DUI sentence

I am on disability, I was sentenced to 15 days in jail, have to ''blow'' (PBT) 4 times a week at a cost of $5.00 per Test thats $80 a month. Friday I have show cause why I have not been paying my fines they want $345.00 Plus I have to take a urine test once a month at a cost of $15.00 per test, This is taking every penny we have. This is my first offense. We get a shut-off notice every month.They (The Judge) know that they are taking our bill money and life essential money . My question, Is this legal? Do I have any recourse?

Yes, it is legal for the courts to impose any conditions, fines and costs allowable under the law, which the above ones are allowable. Unfortunately most courts do not care about your financial situation - they expect you to pay on time. You can attempt to ask for a payment plan and explain to the judge/probation officer that you have limited income and are on disability, but keep in mind that they have heard every excuse/explanation in the book and are not always sympathetic.

If the court does allow you a form of a payment plan, you must follow it, or you will continue to get show caused and have more fines imposed. Try to get a loan from family or friends to avoid this getting more costly for you.
