Legal Question in DUI Law in Michigan

dui/dwi

20 yr old college student was on probation for mip. Currently pulled over for (officer says) taking a corner too fast on a yellow light. Ticketed for underage drinking/driving, but under the legal limit. Faced a judge and was immediately jailed for 15 days. Is it possible to get him released after4 days to complete semester of college, and then finish that sentencing?

Here's what the judge will say besides NO!

"You were on probation and you violated. Now you're on probation for this offense. The next time I see you, you may get the full 90 days. The legal limit for you because you're still a minor is 0%. How do you get under 0%? You're lucky you didn't get charged with OWI."

As a practical matter, by the time you get to see the judge, he'll be out anyway...at least until he violates again.

Where did this happen? What judge handled the violation? Because you did not put in your zip code, I cannot answer this question more fully.

Jailing a person for violating the terms of an MIP sentence may be against the law.
