Re: penalty

The answer is yes, you can go to jail. A first offense carries up to a 93 day jail sentence. Whether you will receive a jail sentence and how long it will be depends upon a number of factors including who the judge is, what your blood alcohol content was, your criminal history and your driving history.

Re: penalty

If your attorney does not beat the drunk driving case, you could potentially face up to 93 days in jail. You should have an experiened, aggressive attorney fighting for you.

Re: penalty

Possible? Yes!

Probable? No.!

It depends on a number of factors, not least of which is the judge who will be hearing your case.

If you can't afford an attorney, the court will appoint one for you at a nominal cost.
