Legal Question in DUI Law in Michigan

rights with alcohol probation

I am 19 yrs old and on probation for underage drinking and have to submit to random drug tests, my question is can i legally go to canada and drink where the legal age is 19 and come back to the states completely sober even though my probation states that i must absatin from the use of alcohol and drugs? I was charged in the city of Fraser MI in Jan 2002

Hello, I have received your post regarding drinking in Canada. The answer is an unequivocal "NO". You will be in violation of your probation if you drink in Canada. The issue isn't whether drinking in Canada is legal at your age. The question is whether the judge ordered you not to drink. He so ordered, therefore you would be violating his instructions. This happens frequently with adults convicted of drunk driving, abstaining from alcohol is a part of their probation even though they have reached the legal age for drinking. John C.
