Legal Question in DUI Law in Michigan

My son totaled a car we, his parents, had insured. The police said he had Xanax (not prescribed) in his blood. No charges issued at this time (10 days after accident). The company's collision expert called it a total and quoted a payout of $6,700. But an adjuster later left a message saying she must talk to my son before anything proceeds. Can the insurance company refuse to pay? He is 22 years old and has an OWII on his record from 2012

He shouldn't make any statements while criminal charges are pending. And you should review your policy carefully i.e. permission to drive the vehicle, criminal acts etc. Some situations may preclude a payout.
