Legal Question in Family Law in Michigan

paternal fraud

A friend of mine just found out through DNA testing that his 7 year old daughter is biologically not his. His ex-wife knowingly led him to believe different. Does he have any legal rights with child support or forcing her to divulge the real fathers name? Is there a way to make the real father pay part or all of the support?

Re: paternal fraud

It's a very difficult situation. The courts would most likely require him to pay child support if he had a parental relationship with the child. If he did not have a parental relationship with the child, then he will most likely get out of paying support. The reason is, it would be devastating to the child to all of a sudden have the man reject the child due to the biological issue. If he wishes to discuss it, tell him to call me at 248-353-9400.
