Legal Question in Civil Litigation in Michigan

civil case against city

My car was damaged when I drove into some unbarracaded road work one night. Police say that a 3rd party (ie neighborhood kids) removed the barracade. Engine damaged was sustained and the city refuses to pay for repairs. I am suing the city in district court (got moved up from small claims) and I have a few questions:

1. Is a lawyer required?

2. What are my chances of winning judgement?

3. What issues of law can I bring up? Negligence?

You do not need a lawyer. However, you seem to be mixing up allegations with proofs. How are you going to prove that the city had sufficient notice to fix the defect? Do you have proof of any calls to the city complaining prior to the crash. Do you know the names of workers who will testify that the defect existed when they left the job site? Just because you make an allegation, doesn't mean anything. William S. Stern
