refuse to deliver item sold to me

I purchased a hot tub used about 2 years ago. Due to various factors i have not been able to pick up the unit untill now. i was asked to remove it about two months ago and when i called them they said they were going to keep it and were not going to give me my money back. This was a friendly purchase at the time and he said he was in no hurry to have it removed. Now are relatinship has gone south. Have i lost my tub as well?

Sue him in small claims court and find out. Most likely, he is asking for storage charges.
