Legal Question in Personal Injury in Michigan

Dog Bite

My daughter was recently bitten by the neighbors pit bull. Not seriously, but it's the dogs second attack (first was another pet). Cops and local attorneys did not do much. Is there a way to determine what homeowners insurance the dog owners have? Is it a matter of public record? I'm sure their insurance company would like to find out about the dangerous dogs at this residence.

No, insurance is not public record. However, if you want to make a claim against them for medical bills or damages for your daughter's injuries, and you send them a notice of intent to sue, they have to forward it to their homeowner's insurance company(i.e., they are required to alert them of a possible claim).

Even if her injuries were not serious (and for her sake, hopefully they are not), dogbite is strict liability in Michigan and you could most likely obtain something for her pain and suffering.

As far as I know, there is no central place where information is stored regarding homeowner's insurance. You'll have to ask the dog owner. Sometimes you can search the Register of Deeds, find the mortgage company, contact the mortgage company who usually knows the insurer. William S. Stern
