Legal Question in Personal Injury in Michigan

foreign object in food

I recentyly bought a 5 pound bag of Tyson Chicken strips, and found a small foreign object in several of the chicken strips. I saved one of them. It is about 1/8'' . I am not sure what it is. I was not injured, but my 7 year old son got a piece lodged in his tooth and swallowed it. Can I sue Tyson? Do I even have a case? I live in Michigan.

You may possibly have a case, if there were any injuries suffered. Did you son require medical attention? Also, you'd have to prove that the object came from the bag of Tyson food. If there were injuries, it is worth at least sending a demand letter asking for money to reimburse you for any expenses and pain/suffering/emotional distress. The worst they can do is ignore the letter. You/your lawyer could then decide if you want to file suit and pursue the matter.

Keep in mind that food companies do not just give out money for these types of claims and are usually skeptical, since some people try to bring fake claims (remember the wendy's chili/finger thing a few years ago?)

But if you have a legitimate claim and injuries, you should at least notify the company of what you found so they can take corrective measures and/or determine if other bags were contaminated.
