Neighbor Flooding My Yard.

I have lived at my current property for 5 years now and when we bought our property the natural flow of water went through the middle of our property. About 3 years ago our neighbors moved in and he was really upset with the flooding of all of the properties. So without my knowledge he put up a berm to stop the flow of water onto his property and now my property has a 40 ft long 20 ft wide 8 in deep swamp that has now back up across my back yard. I have spoken with him about it and he said that he would remove the berm if I was unhappy. Well, I am unhappy and he has not removed the berm. What can i do? Thanks Frustrated Neighbor

Your neighbor has created a nuisance and a trespass by altering the topography of the land. He should be liable to you for damages to your property. You could also seek an injunction forcing the removal of the berm. For more information, please contact my office at (248)8513171.
