Unmarried couple Michigan - suing for partition

What happens when one owner who is a tenant in common wants to cash out and the other owner will not agree to sell?

Your answer lies in the subject line of your entry so it appear you have some understanding. One person may bring an action in Circuit Court for a partition action. Upon hearing the case and quite frequently ordering an appraisal of the property, the judge will order that one party sells to the other under court order. If the one party doesn�t want to sell, it makes no difference in most cases once the judge orders that it be partitioned.

You should file a complaint for partition of the property. At some point a Judge would eventually order a sale and division of the proceeds.
