Legal Question in Wills and Trusts in Michigan

What kind of will kit to purchase.

My father wants to make out a will, he is married, however my mother has Alzheimers and is in a nursing home. Does he still need a will for a married person even though she can not be part of the will decisions and cannot have anything left to her due to her situation.

When drafting and executing a will for a married person, the will should include provisions unique to a married person. In addition, your question raises a number of other state law questions about protection of the marital estate (even if most or all of the assets are in the community spouse's (father's) name. I do not recommend a will kit for this type of planning. Your father should seek the guidance of a qualified estate and elder law attorney to assist him.
