Injury consistantly worsened since original claim

In 2000 I slipped and fe1l on my back while getting out of my patrol car. I hurt my back and filed a workermans comp claim. The doctor took xrays and said I pulled a muscle. The condition never really improved and would flair up quite often. Recently, when stepping off a step stool at home it flaired up again so I finally went back to the doctor. This time he ordered an MRI and it showed a fractered disk. This is the same area that I hurt three years ago. I am now off on disability and will need back surgery. The doctor will not write it up as workmans comp because I mentioned the step stool and he says it will get denied because there is no evidence linking it to the first injury. I know this is an result of the first injury because it never improved. I think it was misdiagnosed to start with. Is there anything I can do to prove this is related to the original claim?
