What is the procedure of putting a lien against a home if the owner of the home owes you money?

Generally, you obtain a judgment and docket it in the county where the real estate is located. Different procedures apply if the money owed is for labor or materials supplied for the construction of the house itself.

Unless you have a mortgage or have done lienable work (as permitted by the lien statute) you cannot lien a homestead of a debtor, generally speaking.

If you have not sued out your claim, you need to locate alternative assets, such as accounts or wages.
