Legal Question in Family Law in Minnesota

kidnapping

my husbands ( american citizen) is neglecting me and the children I don't know what's going to happen tomorrow. Can I leave him and take the children in a sAFE ENVIROMENT and not arrested for kidnapping?? I am their natural mother , and I am a legal resident alien, and tired of being neglected and amotionally abused...my children deserve a real safe enviroment...please helpp
