Legal Question in Family Law in Minnesota

will

I own my own home; if I remarry,

how can I make sure my grown

children wlll get this property if I

should die before my husband? His

name is not on the property and he

would be wiling to sign a quit claim

deed. How would I have a will drawn

up to that effect? Could it state that

my husband could remain in the

home as--name removed--as he

wanted, but

could not sell it?

I suggest you see a local estate planning attorney. You're going to want a will drafted, or some similar device that dictates what happens to the property. You could create what is known as a life estate for your husband, but you really need to consult an attorney to make sure this is drafted properly.
