Legal Question in Criminal Law in Mississippi

not able to be in court

i found out yesterday that im supposed to be in court tomorrow. I was not notified by the court that i was to be there. I'm a state witness on a drug charge. I'm out of town and not able to get there tomorrow. What should i do?

I take it that, from your question, you were not subpoenaed. Thus, I wouldn't worry about it unless your testimony was part of a deal that you struck with the district attorney yourself on a charge that you may have. If the latter is true, contact your attorney and let them handle it. If you were subpoenaed and don't show up, you can be cited for contempt of court and arrested.

There is no minimum notice time requirement for subpoenas. However, you may not have been sufficiently served. Telephone the attorney that subpoenaed you and describe your situation. It may be that the case can be continued a little while for you to return to town.
