Legal Question in Family Law in Mississippi

What should I do now? Please Help!

My 5 year old son lives in Mississippi. I have already been to court and the judge granted me legal joint custody and proper visitation, that the mother never let me have. Since the order I have had to travel to Mississippi to pick up my son twice. With in these two times I have had to call the police department for a escourt because she refused to let me take my son even though I had the court order. Along with that I am to have phone visitation 2 nights a week which I am lucky if she answers the phone twice a month. Not only that the mother has broken ever court order in the judgement. There is so much more I could go on forever. I have already spend so much money in lawyer fees. Before I spend anymore I need to know if I am going to have a chance in Full custody and if so how much of a chance?

Thank you

The Court will not change custody as a sanction unless everything else fails. So you have to continue seeking sanctions for violations of the custody agreement and part of the sanctions should be attorney fees and all your other costs of having to obtain contempt orders.

Alternatively, if you can show a substantial material change of circumstances that justifies a change in custody you may be able to have a change ordered on that basis.

You may not be able to get custody, but I'd try for it since she has essentially not followed any of the judges order. Also, any time you take her for contempt, you need to be requesting and getting atty fees.

Let me know if I may be of additional assistance.
