adultery in a split

I live in MS and me and my husband split. During that split I had and affair one time and I came clean about it when we decided to get back together. Now he is saying that adultery will give me five years in prison plus the affair gives him grounds to take my son. Help me

Adultery remains on the books but it is not prosecuted. The adultery can however be considered as a factor along with many others in determining which parent should have custody of your son, and it generally carries no greater weight than any other factor. The court does not use child custody as a means to punish a parent. In a custody issue, it is solely interested in the meeting the child's best interest.
