Dead Beat Ex

My divorce was final July 2000 & my ex was ordered to pay a minimum monthly child support plus half of all medical expenses, health insurance, etc. for 2 children. I have sent him receipts of all these expenses by certified mail & he currently owes me over $8000. Is this not contempt? Why must I again pay attorney fees and court costs to make him do what he's already been ordered to do?

A contempt action is a "wholly new" matter which requires filing "new" papers with the court. Your EX is definately in contempt and the judge will probably award you attorney fees. Getting paid is again a different story which is why it will be hard to find an attorney willing to "wait" to get paid.

If your children are on medicaid, you can get DHS to go after him. This would be a long slow process however.

Based upon the info you have given, your ex is in contempt. You need to file a petition for contempt and the court should award attorney fees. I doubt an attorney will take the case without you paying a retainer. THe court should award you your attonrey fees.
