Legal Question in Civil Litigation in Mississippi

Small claim won, now being appealed

I recently won a case in small claims court against a new car dealer. The dealer appealed the decision, and it will now be heard by a higher court. When the case is heard in the higher court, do I have to hire an attorney, or can I handle this myself? The initial case was only for $300.00.

Re: Small claim won, now being appealed

The case will be tried all over again in county court. Once the appeal has been accomplished, you will need to set a trial date. The trial can be in front of a jury if a party requests it or in front of just the judge. It doesn't seem practical to hire an attorney since such a small amount is in controversy. However you may want to consult an attorney to see if more substantial claims have been overlooked and can still be included or if you can claim your attorney fees as well.
