Legal Question in Wills and Trusts in Mississippi

Possible fraud of a Will

My uncle passed away 3/6/02. he lived in our family home of 39 years for past 10 years, was even deeded a portion of said property until his death. Now, someone outside the family has laid claim she has a will leaving her everything in the family home and the said property. We believe the will has been falsified with his signature. He was a aclcoholic past 20 years, and over past several years very ill. We need to know if she does indeed have the right to property, as she has put locks on house. And has refused right to the last living brother, who originally owned property along with my grandmother. Can we contest?

Re: Possible fraud of a Will

You need to file for probate in the chancery court. You may also want to file for a restraining order against her to keep her from disposing of any of the property. She will have to prove her will is legit, and if she is not of the family she'll have a hard time more than likely due to the requirements to validate a will.

Right now you need to file for probate and restraining order to protect your assets and rights.
