Uninsured driver caused an accident

I was recently in a car accident with another person. The other vehicle, police, and of course my self understand that the accident is the other vehicle's fault. However I understand that insurance companies find some percent of fault on both sides.

Anyway, once the police officer showed up, he got the stories and insurance of myself and the other vehicle.

It turns out the other driver has been without insurance on the policy number he provided the police for over a year. I myself had the bad luck of my 6 month's coverage elapsing the day prior to the accident. So neither of us had insurance. THe other vehicle has been playing games with the police, the police claim that the ball is stuck in my court and that ''I'm up a creek'' in their own words. Can you tell me if knowingly providing proof of insurance to the police you know is expired is a felony? Also, shouldn't the police have done more at the scene to verify insurance? What course of action can I now take? Thanks for the help.

First of all, it would not really help you to get involved trying to have the other driver prosecuted for supplying false info. If you were hurt or suffered property damage there are a couple of things you can do. First, you need to file suit against the other driver. Once you have obtained a judgment, you can report the judgment to the Department of Revenue and they will suspend the other driver's license until some arrangements are made for payment.
