Legal Question in Landlord & Tenant Law in Missouri

What can I do about my landlord harrassing me?

My husband and I separated, and I was left with the cleaning, repairs, and bills. I found a subleasor per my landlords request, let her keep our deposit for last month's rent, and cleaned and repaired the house. She then tried to have me replace normal wear and tear and previous damages, and wouldn't let the subleasors move in for 1/2 a month for no good reason. She has been calling my work for 3 months now (over 25 calls, some threatening to show up at my work, all threatening to take me to court) for the 1/2 rent, and bogus damages. I have told her to take me to court to settle this, and she won't. Is there a certain time limit on her taking me to court after I move, after which she cannot pursue it with the courts? How do I get her to leave me alone or settle this in court once and for all? Thank you for your help.

Re: What can I do about my landlord harrassing me?

It depends on the state.

If she is a bill collector or an attorney as defined in the Fair Debt Collection Practices Act, you could pursue that angle for being her being menacing or threatening.

In Missouri, a landlord must provide a tenant IN WRITING after moveout notice of when the walk through inspection will take place for purposes of making deductions from the deposit. WITHIN 30 DAYS FROM THAT INSPECTION, landlord must provide another WRITTEN itemized list of deductions from the security deposit or refund the money.

If she is really bothering you, wait about 45 days, and then sue her if you haven't received two letters in writing. I may be reached at 816-842-3717 if you need help. Matt Guilfoil
