Cosigner Options Help

My ex who I cosigned for claims she refinanced a year ago and I am no longer in contact with her. She has now had the vehicle repossed and I just got a letter from the Bank saying I owe the remaining balance. What are my options?

Re: Cosigner Options Help

You can try suing her if the agreement was that she would take you off the loan but didn't (e.g., the divorce decree provides she'd hold you harmless on this debt.)

But as to the bank, if you're still a signor on the loan, your options are to negotiate a repayment of the debt so that it doesn't negatively affect your credit. It would be reasonable to demand a copy of the loan documents upon which the bank is relying to make sure that you are still on the loan. If you are a co-signor though, you are fully liable for the deficiency.
