competency of adult child

39yr old child with serious gambling problem.$25,000.00 lost within last 6mths.Money was from settled law suit,all gone.Now in danger of losing house and job.He has little education and is considered unskilled labor. he has exhusted all resources and continues to gamble. can we gain controll of finances in some way to keep him from losing everything?

Yes, but it would be very tough. You need to get a guardian of the estate (this deals with money issues) and would have to convince a judge that he is so incompetent regarding money that he cannot take care of it.

This is a lesser standard than guardian of the person where you need to show that the person is unable to care for himself in any way. We would probably need to hire a psychiatrist to testify that he needs help.
