Family Law - Child Support

If DNA testing proves that I am NOT the biological father of a child, am I responsible for Child Support when I separate from his mother? Child is now 10 yrs old and my name appears on the birth certificate.

The answer to that question is "it depends". There is a presumption that arises by law that a child born during a marriage is your child. Also, having your name on the child's birth certificate raises a presumption that you are the father and the court can determine that since you are the only father the child has known his whole life that you should have a continuing relationship with that child for the child's best interests. It is complicated to say the least.

If you have raised the child 10 years you will be deemed to be the father by the principle of equitable adoption unless the natural father comes forward and offers to pay child support. lol
