Legal Question in Credit and Debt Law in New Jersey

Being Sued by Debt Collector

midland Funding bought my debt from newport news credit card (fcnb). the account was opened in 2001 and written off after non payment, now midland funding being represented by Pressler and Pressler is stating I owe 1092 dollars when my card limit was only 400. I had to submit an answer to the hackensack nj court which I did and a court date is set for July 29. I dont know what to do at this point. I dont feel I should have to pay what they are asking when my limit was only 400 and I dont even owe to them. This account was written off. I truely dont recall when I made the last payment so I dont even know it this account is outside the Statute of limitations. Midland funding is making it look as though they been trying to collect since 2007 and even reported it on my credit report as a collection but I never knew a thing till I got the letter in the mail stating ''YOU ARE BEING SUED'' I dont know how to fight this. I am willing to pay the 400 even though I dont feel they deserve it but I cant pay the 1092 plus interest and court costs. What is the best way to fight this without a laywer? A lawyer would probably exceed what I owe so Im trying to do this on my own. Please advise.

Re: Being Sued by Debt Collector

You are right, the amount is rather low for you to get an attorney. I suggest you go to court and work out a settlement. They almost always have mediators there and 99% of cases settle.
