This is a potentially serious criminal charge that could possibly lead to some jail time and having a criminal record, as well as having to pay heavy fines. YOur brother should definitely consult with a lawyer. Any way you look at it, he probably would not even be allowed to proceed in county court on a criminal charge without at least having the public defender's office represent him due to the potentially serious nature of the crime. I would have to see exactly how they are charging him. He could get PTI, which is a program where his charges may get dismissed if he stays out of trouble for a certain period of time or he could get probation if convicted.

Thus, while I don't see him looking at jail time, he may get a criminal record if things don't go right. Thus, he should see a lawyer. My consultations are always free, so have him call me at 732/247/3340 and we'll discuss the case.

Depending on how he is charged it could be a third or fourth degree crime that he is charged with. In either event, if he is a first offender there is a presumption that he will not go to jail and he would be eligible for first offender

treatment.
