DUI: Reciprocration between NJ and PA

If I have 2 DUI charges in PA and I just got arrested for a DUI in NJ, could I face charges for 3 DUIs?

There are two things you need to know. The dui in New Jersey could become your third dui conviction.

Secondly, in New Jersey serving a jail sentence is

mandatory, a six month jail sentence that can be reduced to 90 days by spending 90 days getting in-

patient treatment..

Of course, if you win one of the three dui charges you could avoid a jail sentence in New Jersey. Also, if you New Jersey dui becomes a conviction before both of your dwi charges become convictions, you would not be sentenced a a third time offender, assuming that you have no other, prior dui convictions.

It depends. You could be facing a third dwi. However, if you received ARD for your 1st offense in PA and you successfully completed the program, the NJ offense may constitute a 2nd offense. Also, a lot depends on the dates of your PA dwi's and the breath readings.
