Legal Question in Education Law in New Jersey
Mis-diagnosed Learning Disability
My son was diagnosed at Dyslexic in 2nd grade and has been in remedial classes since then. Now a HS junior. Most recent test indicate he's not DL- but ADD-Inattentive. On meds 1 month.( no medication for DL- only ADD) Grades from D's to B's. Now its clear that had he been on meds all along he would haev had as college prep curriculum and been looking at colleges now instead of trade schools etc. He has been damaged by this misdiagnose. Do we have recourse? Can a Speical services Dept be sued for ''malpractice''? thank you
