Legal Question in Civil Litigation in New Jersey

Neighbor Harassment?

Hi, we have lived on a quiet dead end street for 15 years now and never had a problem with any neighbors or the law. About two years ago, a couple with a young child moved in across the street. We were friendly at first. However, over time my three children grew up and got there licences. We have no driveway, and therefore must park elsewhere. When we park across the street, the neighbor calls the cops. The cops cant make us move the car, but everytime anyone in my family does, he will call the cops anyway. He has even gone to the extent of taking pictures of the cars and my wife and children getting out of their cars. Since it began, he has not given up. He has filed criminal complaints, one for obstruction of contractors. In that case the cars were moved willingly. One for noise when listening to a baseball game when barbecueing, and the thrird he even tried to pull the race card. All these cases have passed and been thrown out. We avoid him and his family 100%, but it seems like he is instigating us and wants me or my family to do or say something. It is such a hassle to feel like you cant go outside for the fear of doing something and having the cops called for no real reason. Any advice is much appreciated. Thanks

Re: Neighbor Harassment?

You may want to consider consulting with an attorney about the possibility of filing a civil suit for malicious prosecution.

Re: Neighbor Harassment?

When court actions are filed without a reasonable basis for same the law characterizes this conduct as being malicious prosecution which can entitle the victim of same to damages.

I would suggest that you hire an attorney to write this problem neighbor to advise him of your right to sue him for the frivilous complaints he has filed against you

and to offer him the opportunity to resolve this problem within your small community by meeting and attempting to resolve this problem before you are compelled to sue him.

Re: Neighbor Harassment?

In addition to what the other attorneys wrote, I think you should press charges against them. You may need an attorney to help you if the police do not care.
