Legal Question in Immigration Law in New Jersey

2 Pending Immigration Applications

My father a LPR filed an I-130 7-8 yrs ago and i finally received a letter stating my visa has been granted 2 weeks ago. However, after my filed for me I married a USC and received the 2yr greencrd. My 751 application was denied last week b/c me and my USC wife divorced and the officer was not convinced of my marriage. My question can i still obtain a green card from the I-130 filed by my father 8 yrs ago which was now approved. And can i adjust while i am here in the US.

Re: 2 Pending Immigration Applications

You may be eligible to apply for your green card based on the application filed by your father, but you should have an attorney review, both your father's application for you as well as the I-751 denial letter. Further, if you are eligible to file for your green card based on your father's application, then you must do so ASAP. I would also recommend that you do so with the assistance of an attorney.
