H1-h4-h1

Hi I got my H1 on October 2008 but didn't get a job, I'm back on H4 now but I want to apply for H1 again, so

Am I subjected to the visa cap?

How do i go about changing my status back to H1 again?

We have been successful in many similar cases in which a beneficiary, like yourself, had an H-1B petition approved, never worked for the petitioning employer, and was not subject to the H-1B cap on a future H-1B petition.
