Legal Question in Employment Law in New Jersey

Not being paid for 5 weeks

I worked for a restuarant that was in a hotel. The hotel evicted the owner and took the place over. Now all the employees are owed paychecks. Some two weeks others 5 weeks. We are told by the owner next week he will take care of our oay. We have been hearing that for about 2 weeks. We all have bills to pay. He wrote the checks out knowing there is no money to cover the checks. If we bring old checks to the bank they tell us the owner froze the accounts and they can not cash them. What can we all do. The labor board has been involved but it seems they get around that somehow. Please help us.

Re: Not being paid for 5 weeks

You likely are entitled not only to be paid but to an amount equal to what you should have been paid as "liquidated damages" under both NJ and federal law. Additionally your employer may be responsible for your attorneys fees and costs. I handle these cases regularly in NJ as well as FL and NY. Feel free to call me to discuss at (877)456-WAGE.
