Power of attorney forms

My husband and I are seperated. He lives in New York, I live in New Jersey. I live in the home bought during the marriage , in N.J. I want his mother to act as power of attorney. Therefore the power of attorney forms from N.J. should suffice for N.Y. , right???

Maybe but you don't provide enough facts to be sure. Where is the Power most likely to be exercised? If one state is predominant in that regard I'd use their form but w/o reviewing NY law I could not tell you if a NJ POA would be honored at all even thugh states are supposed to give "full faith and credit" to acts done under the laws of other states, if that state had jurisdiction and any atorney could write a book on that.

There are many fine northern NJ attorneys who are licensed to practice in both states. Do you really want to risk adversely affecting or even losing property that may be worth tens of thousands of dollars because you used the wrong $5.00 form when an atorney will ensure it's right for under $200.00?

You and your husband are separated. You are going to change the ownership of your house. And you are doing this without any expert advice. Why?

You could be doing huge harm to yourself. You need to go see an attorney NOW. Do not sign any document or take any action until you see an attorney. You may spend $200 for a consultation, and save yourself from losing thousands of dollars. Get a lawyer, one who handles divorce issues as a large part of what the attorney does. Find someone reasonably near you.
