Legal Question in Real Estate Law in New Jersey

Sold House / had U&O and now having problems.

Sold house closing beginning of Jan. Had a Use & Occupancy agreement to live in the house for up to 60 days. Buyers Attorney held $5,000 of my money in escrow in case of damages during my occupancy after closing. I moved out within 45 days and left no damage. Its been 3 weeks and the attorney is holding my money still citing a list of damages are forthcoming. I want to get back my 5,000 immediately. There should be some time limit where the buyer can claim damage to the property as they are creating a petty list of things that they find as they live their for 3 weeks now.

What can I do to get money back right away. My real estate attrny is not helping.

Sit tight for a bit. There is a time limitation of thirty days that may apply to your situation. If the landlord misses the deadline, he cannot claim any damages.

Under you circumstances, I suspect that the statutory time limit does not apply, but it is work the short wait to gain that leverage if it does. After that, if you have trouble getting back what is due to you, you can contact me by phone or email.
