Picture Authorization from employees

Good morning,

I am currently the head of marketing for a manufacturing company, and produce/distribute materials that actively promote our company. My question is; If we use photos w/ no names that include employees, which are taken within our factory, do we need a consent form or their permission? Thanks.

Generally jus tto be on the safe side i would get authorizations from all involved - there have been cases where peple have sued for unauthorized use of likeness for profit... this could be the case in your situation. In NY, you will need a written consent if this issue isn't already covered in one of your employment contracts.

Under all circumstances, whether specifically required in any state's law or not, obtaining releases and consents is a prudent practice. Use of a person's picture in advertising material without their consent or not can lead to litigation for misappropriation of one's likeness.
