Legal Question in Constitutional Law in New York

Flag waving as free speedh

My mother is a unreconstructed confederate from Texas. She says that the law prohibits people from flying the Confederate flag. I say flag waving is fee speech no matter what flag you wave and can not be made illigal. Who is right?

You both may be. Flying the confederate flag may be illegal for a state or local government, but it would be free speech if done by an individual.
