Legal Question in Consumer Law in New York

Bought car out of state but car came not as described in listing

I bought a car from Florida and I live in NY. The dealer listed the car as having 74,000 miles and a 6 disc CD changer. When the car came a week later it had 194,000 more miles than as listed and there was no 6 disc cd changer. I have tried to contact the seller but he seems to be avoiding my calls. Is there anything I can do?

You should seek to have the contract rescinded - you return the car, he returns your money. You will need to sue in a FL court, in the county where the seller lives. Depending on the amount in controversy, you may be able to sue in small claims court. If you have further questions, please post in the FL forum, and we will be happy to answer your questions.
