Legal Question in Credit and Debt Law in New York

SOL past, collections agency reposts to credit report as new debt

A collection agency is trying to bill me for a dental bill from early 1999 (about $300). The bill was paid in cash, but I have no receipt so I can't prove it. If I owed them the money, I'd pay it, but I don't. The 6-year statute of limitations is now past. The collection agency had reported this to the credit bureaus in the past, but the entry dropped off. Now, the same agency has reposted this old debt on Experian with a date of September, 2005. I've already disputed this with Experian, to no avail.

How can I (a) get them to stop trying to collect, and more importantly, (b) get this off my credit report?

The 'sol' makes the debt uncollectable, but does not dissolve the debt. The money is still owed, but cannot be collected.

It is tough. Cash payments can be tough. The dentist is the only one who can help you.

You can negotiate. If you send them 100 dollars, they may agree to remove the claim from your credit. You must be careful and not admit any money is owed. Only that you want their help in correcting an error in your credit report.

Be careful. Admit nothing, only ask help in improving your credit score.
