If you have someone without a static address and they keep avoiding being served costing you money everytime you have to have them served, can you sue for the financial troubles to be reimbursed?

Did you invoke the service-by-mail rules of CPLR 312-a? If so, and the defendant does not send back the acknowledgement of service, then ALL service fees are taxable, EVEN IF YOU LOSE THE CASE. If you did not invoke 312-a, then you don't get service fees, regardless of the defendant ducking etc.
