protest myself to hit 13 years old kid

Will I get a big punishment for the offense charged of 120.00?

One more question, if this is my first time, how the judge will charge on me?

Its not necessarily how the judge will charge you but your outcome will likely rely much more on the DA's perception of the case. Section 120.00 of the Penal law is a class "A" misdemeanor with a jail term of 0-1 year in jail (county jail not prison). You also face fines of up to $1000.00 and restitution.

The likelihood is you will get no worse than a split sentence of no more than 60 days and 3 years probation.

If the victim is 13 there is a chance that the punishment could be harsher.

It would be in your best interest to hire a lawyer for this matter. It is an especially difficult kind of case and would be better handled by a lawyer.
