Legal Question in Discrimination Law in New York

another shared driveway dispute!

My family and I have been living in this house for 17 years. We share a driveway with the house on our left. The house has been abandoned until 2005.

The owner does not live in the home but has converted this 1 family home to a 2 fam home. The tenants rent the home and now park in the driveway when our car is not there.

However, when I come home and there is no parking on the street, I want to park in the driveway like I have been doing for years. Our driveway is narrow. I drive an SUV and cannot get to the back but they can because they have a car.

Do we have rights as owners over the driveway more than the next doors tenants due to them are renters?

This question cannot be determined without seeing your deed. Go to a lawyer and have him read your deed. I might also contact the owner of the building and tell him that if the driveway is not vacated that you may be calling the building dept. to see if that former 1 family home is now "up to code". If it isn't inform the building department and these new renting neighbors may soon be looking for new digs.
