Change in Child Custody

My ex-wife currently has full custody of our two children; ages 7 and 9 respectively. The children want to come and live we me (their father) and step-mom. Their mother has agreed to this. What do I need to do to protect my interests and the interests of the children? Thank you.

You must put the agreement in writing and have both signatures notarized. I would suggest that you do a so ordered stipulation and get the matrimonial judge to So Order the agreement. So that a retraction thereafter is a breach of an Order not just a breach of an agreement.
