Legal Question in Family Law in New York

To Whom It May Concern,

I just got a 2 year restrain order agains my husband who i have not lived with for over 2 years. I have 2 children with him who he sees maybe on the weekends if he feels like it and when he does he is abusive to me this is why the restraining order. he has not made one medical or education decision in the last 2 or so years for the children nor has he been financially responable for them. do you think that I could or should file for sole legal and physical cusody (pardom the spelling )

If he wants visitation I want it to be supervised,,,right?????????

thanks Cherie

Yes, you can file for sole custody of the children.

You should also file for child support as well.

Should you wish to discuss this in further detail feel free to call us at 212-962-1031.
